General Terms and Conditions of Sale - France and EU

These General Terms and Conditions of Sale ("GTCS") apply to sales made through the Je Peux Pas J'Ai Golf online store, operated by JPG LIFESTYLE, to consumers located in France and the European Union.
Our aim is simple: to offer carefully made products and handle every order and every customer with the same attention.
If you encounter a problem with an order, contact us. We will first work with you to find the simplest and fairest solution.
1. Seller identity

2. Products
Je Peux Pas J'Ai Golf sells, among other things, clothing, caps, towels, and accessories intended for the world of golf.
The essential characteristics of the products are presented on their product page.
Photographs and representations are produced with the utmost possible care. Slight differences in color or appearance may notably result from screen settings or the characteristics of the materials used.
3. Made-to-order production
Certain Je Peux Pas J'Ai Golf products are made or printed only after they are ordered.
This approach allows us to limit unnecessary inventory and overproduction.
Each piece is created for a golfer, not for a warehouse.
However, the fact that a standard product from our catalog is made to order does not, by itself, remove the consumer's statutory right of withdrawal.
4. Prices
The applicable prices are those displayed on the store at the time the order is placed.
JPG LIFESTYLE currently benefits from the VAT exemption for small businesses. VAT is therefore not applicable in accordance with Article 293 B of the French General Tax Code.
Any delivery charges are indicated to the customer before their order is definitively validated.
5. Order
The customer selects the products they wish to order and checks the contents of their order before proceeding to payment.
The order becomes final once payment has been validated and the order confirmed.
A confirmation is sent to the customer at the email address provided when placing the order.
In the event of an obvious error concerning a product, its price, or its availability, JPG LIFESTYLE will contact the customer to seek a suitable solution.
6. Payment
Payment is made using the payment methods offered on the store at checkout.
Transactions are processed by the payment providers available on the store.
JPG LIFESTYLE does not have access to the complete banking details used to make the payment.
7. Delivery
The products are delivered to the address provided by the customer when placing the order.
Available delivery times or estimates are indicated when placing the order or in its confirmation.
As some products are made to order, their shipment may require a production period before they are handed over to the carrier.
In the absence of an agreed date or time frame, French law provides that the goods must be delivered without undue delay and no later than thirty days after the conclusion of the contract. �

8. A problem with your order? Contact us
This is the most important point.
If your order is damaged, incorrect, incomplete, appears to be lost, or has a defect, write to us directly at:

To help us quickly understand the situation, you may provide:
your order number;
a brief description of the problem;
and, when useful, a few photographs of the product and/or its packaging.
We will endeavor to find a simple and fair solution with you, which may include a replacement or refund depending on the circumstances.
This practical contact procedure in no way limits your statutory rights.
9. Right of withdrawal — 14 days
When the right of withdrawal applies, the consumer has 14 days from receipt of the goods to inform us of their decision to withdraw, without having to provide justification.
To exercise this right, the customer may use the withdrawal feature available in the store when offered, or send us a clear statement expressing their wish to withdraw.
They may also use the model form provided at the end of these Terms and Conditions of Sale.

10. Return after withdrawal
After communicating their decision to withdraw, the customer has 14 days to return the product.
Unless otherwise indicated by us, products concerned by a withdrawal must be returned to:

Please contact us before making the return so that we can easily identify your order and, if necessary, provide you with the relevant instructions.
The direct return costs are borne by the customer.
The law does indeed provide that these costs may be borne by the consumer when they have been informed of this in advance.
11. Inspection and condition of the returned product
You naturally have the right to examine or try a product in the manner reasonably necessary to verify its nature, characteristics, and proper functioning.
However, use beyond what is necessary for this verification may result in depreciation of the product for which the consumer may be held responsible.
For a garment, this means in particular that reasonable try-on is possible, but a product worn for an extended period, washed, damaged, or used beyond a simple try-on may have lost value.
12. Personalized products
In accordance with the Consumer Code, the right of withdrawal may in particular be excluded for goods made to the consumer's specifications or clearly personalized.
This may, for example, concern a product specially made at the customer's request with:
their name or initials;
a logo or visual they requested;
the name or specific identity of their club, company, or organization;
or specific personalization carried out specially at their request.
JPG LIFESTYLE does not consider the mere manufacture on demand of a standard product from the Je Peux Pas J'Ai Golf catalogue sufficient, on its own, to remove the right of withdrawal.
Thus, when a T-shirt, cap, or another standard JPJG item is simply ordered in a size or variant offered in the catalogue, we apply the right of withdrawal when legally applicable.
13. Refund in the event of withdrawal
In the event of a valid withdrawal, JPG LIFESTYLE refunds the amounts owed to the consumer, including the standard delivery costs initially paid.
If the customer voluntarily chose a delivery method more expensive than the standard delivery offered, the corresponding additional cost does not have to be refunded.
The refund is generally made using the same payment method as the one used for the order.
JPG LIFESTYLE may defer the refund until the product has been recovered or until it receives proof that the product has been shipped, whichever occurs first.
14. Defective or non-conforming product
The right of withdrawal should not be confused with the rights available to the customer when a product is defective or non-conforming.
JPG LIFESTYLE is the seller to the consumer and remains their point of contact, including when the manufacture or shipment of a product is carried out by a partner.
